Short title and beginning
1.This Act is the Birth and Death Registration Act 2021 and will come into force on a date designated by the Minister by notice inGazette.
interpretation
“Authorized Registrar” means a Registrar authorized by the Registrar General to exercise some or all of the powers of an Authorized Registrar set forth in Part 8;
"Birth" does not include stillbirth;
(A) | all information about the child required under this Act or for birth registration purposes under this Act, including a name for the child that complies with Section 19(1) and is not denied by the registrar under Section 19(2); And |
(B) | any other data about the child provided by the registrar on a website required for registering the birth; |
"Birth Registration" means the registration of the birth of a child under this Act;
“Coroner” has the meaning given to it by Section 2(1) of the Coroners Act 2010;
“Coroner's Certificate” means a certificate issued by a coroner under the Coroners Act 2010 in relation to a death;
"Death" does not include stillbirth;
(A) | all information about the deceased that is required under or by virtue of this Act for the purpose of a death certificate, including the cause of death of the deceased; And |
(B) | any other data relating to the deceased that the Registrar General places on a prescribed death registration website; |
"Death Registration" means the registration of a death under this Act;
“Forensic Pathologist” has the meaning given to it by Section 2(1) of the Coroners Act 2010;
"Information" includes documents;
"legal guardian" for a child or minor, a person who has been appointed by law, by deed or will or by order of a court of competent jurisdiction, to be the child's or minor's guardian;
"Limited Liability Company" has the meaning given to it by the Limited Liability Companies Act 2005;
(A) | in the case of an aircraft: the master of the aircraft; |
(B) | in the case of a train: the driver or any person who is driving or loading the train at that time; And |
(C) | for a ship: any person (other than a pilot or harbor master) who at that time controls or directs the ship; |
"Physician" means a physician registered under the Medical Registration Act 1997 who holds a valid professional license issued under that Act;
“Minor” means a person under the age of 21;
"Occupant" for any Premises means a person who occupies, controls, is responsible for or administers the Premises (either on their own behalf or on behalf of another person);
"Pathologist" has the meaning given to it in Section 2(1) of the Coroners Act 2010;
“Protector” has the meaning set out in Section 2(1) of the Children and Young People Act 1993;
"Registrar" means registration of births, registration of deaths or registration of stillbirths;
"Recorded Event" means any birth, death or fetal death recorded under this Act;
“Recordable Event” means any birth, death or stillbirth that must or may be registered under this Act;
“Chancellor General” means the Registrar General of Births and Deaths appointed pursuant to Section 3(1);
“Registrar” means a person appointed as a Registrar pursuant to Section 5(1);
“Repealed Act” means the Birth and Death Registration Act (Cap 267), which is repealed by Section 62;
“Recordable Death” has the meaning set out in Section 2(1) of the Coroners Act 2010;
"stillbirth" means the birth of a stillborn child;
(A) | all information about the stillborn child required under this Act or under this Act for the registration of the stillbirth, including the cause of death of the stillborn child; And |
(B) | any other data relating to the stillborn child provided by the Registrar General on any website required for the purposes of stillbirth registration; |
"stillbirth record" means the record of a stillbirth under this Act;
"stillborn child" means a child born after the twenty-second week of gestation of the child's mother and at no time showing signs of life after being fully expelled or withdrawn from the mother.
(A) | deviating dates of birth according to paragraph (B) the definition of “dates of birth” in paragraph (1) for children in different circumstances; |
(B) | various details of death under paragraph (B) the definition of “dates of death” in paragraph 1 for persons who died in other circumstances; And |
(C) | different information on stillbirths under paragraph (B) the definition of “stillbirth dates” in paragraph (1) for stillborn infants in various circumstances. |
(A) | the registration of a birth contains a reference to the re-registration of a birth; | ||||
(B) | a birth registered under this Act contains a reference to -

(C) | a death registered under this Act contains a reference to a death registered under the repealed Act; | ||||
(D) | a stillbirth registered under this Act contains a reference to a stillbirth registered under the repealed Act; | ||||
(mi) | A logged event contains a reference to:

(F) | a certificate issued under this Act shall contain a reference to a replacement certificate issued under this Act, a certificate issued under the repealed Act or an equivalent document issued under the Adoption of Children Act 1939; | ||||
(Gramm) | an extract issued under this Act shall contain a reference to an extract issued under the repealed Act or equivalent document issued under the Adoption of Children Act 1939; | ||||
(H) | a country or territory contains a reference to the territorial waters of that country or territory; And | ||||
(I) | each premise contains a reference to a portion of those premises. |
"Child Adoption Act 1939" includes the Child Adoption Act (Cap.4, 2012Ed.) pending revision and citability under the abbreviated title "Child Adoption Act 1939";
"Children and Youth Act 1993" includes the Children and Youth Act (Cap.38, 2001Ed.) pending revision and citability under the abbreviated title "Children and Youth Act 1993";
"Coroners Act 2010" includes the Coroners Act (Cap. 63A, 2012Ed.) pending revision and citability under the abbreviated title "Coroners Act 2010";
"Criminal Procedure Code 2010" includes the Criminal Procedure Code (Cap.68, 2012Ed.) up to revision and citability with the abbreviated title "Criminal Procedure Code 2010";
"Evidence Act 1893" includes the Evidence Act (Cap. 97, 1997Ed.) until revised and citable under the abbreviated title "Evidence Act 1893";
"Financial Procedure Act 1966" includes the Financial Procedure Act (Cap.109, 2012Ed.) pending revision and citability under the abbreviated title "Financial Procedure Act 1966";
"Infectious Diseases Act 1976" includes the Infectious Diseases Act (Cap.137, 2003Ed.) pending revision and citability under the abbreviated title "Infectious Diseases Act 1976";
"Legitimacy Act 1934" comprises the Legitimacy Act (Cap.162, 1985Ed.) pending revision and citability under the abbreviated title "Legitimacy Act 1934";
The Limited Liability Companies Act 2005 comprises the Limited Liability Companies Act (Cap. 163A, 2006Ed.) pending revision and citability under the abbreviated title Limited Liability Companies Act 2005;
"Medical Record Act 1997" includes the Medical Record Act (Cap.174, 2014Ed.) pending revision and citability under the abbreviated title "Medical Record Act 1997";
"Merchant Shipping Act 1995" comprises the Merchant Shipping Act (Cap. 179, 1996 Edition) pending revision and citability under the abbreviated title "Merchant Shipping Act 1995";
"National Registration Act of 1965" includes the National Registration Act (Cap. 201, 1992Ed.) pending revision and citability under the abbreviated title "National Registration Act of 1965";
"Penal Code 1871" comprises the Penal Code (Cap. 224, 2008 Ed.) pending revision and citability with the abbreviated title "Penal Code 1871";
The Status of Children (Assisted Reproductive Technology) Act 2013 comprises the Status of Children (Assisted Reproductive Technology) Act (Cap. 317A, 2015Ed.) pending revision and may be abbreviated as The Status of Children (Assisted Reproductive Technologies) Act 2013”.
